Legal basis: the Act of 24 September 2010 on population registration (consolidated/unified text Journal of Laws 2015, Item 388)
The PESEL number is applied for ex officio by the municipal office dealing with registration of foreigners residing in the territory of the Republic of Poland who received a temporary or permanent residence permit.
The list of statuses conferring the right to grant the PESEL number:
- a permanent residence right acquired by a citizen of an EU Member State, a citizen of an EFTA Member State – a party to the agreement on the European Economic Area and a citizen of the Swiss Confederation
- a permanent residence right acquired by a family member of a citizen of an EU Member State, a citizen of an EFTA Member State-a party to the agreement on the European Economic Area and a citizen of the Swiss Confederation
- a permanent residence permit
- a residence permit for a long – term European Union resident
- refugee status
- subsidiary protection
- asylum
- tolerated stay permit
- temporary protection
- authorisation to stay for humanitarian reasons for foreigners' family members residing n the territory of the Republic of Poland
Assigning a PESEL number upon the request, under Article 7, paragraph 2 of the Act
Foreigners staying in Poland based on other than the aforementioned residence regulations can obtain the PESEL number upon the request, only if a person is obliged to hold the PESEL number.
In accordance with Article 18 of the above-mentioned Act, the application for the PESEL number is filed at the office competent for granting a permanent or temporary residence permit. If a foreigner does not hold a registered residence certificate, the application is filed at the office competent for a company's registered seat. If the competent municipal office cannot be determined, the application is to be submitted to the competent office of Śródmieście district of the capital city of Warsaw.
The application shall include a reference to the legal basis for an obligation to hold the PESEL number and the documented data.
The application form can be obtained at the municipal office.
Applications can be submitted to the Population Register Unit located in 4 Młyńska Street, 1 st floor, rooms: 105, 108 – 109.
